"The Company" means Equinited Limited.
"The Service" means the Stable Manager mobile apps, the Stable Manager web app, and the Stable Manager website together with the supporting data servers.
"The Intended Use" relates to the use of the Service which is to assist with the management of equestrian stables, including the storage of information in connection with the management, wellbeing and performance of horses.
"The Users" means people who have created an account to log in to the Service.
Please read these Terms and Conditions carefully before using the Service. By accessing or using any part of the Service, you agree to become bound by these Terms and Conditions. If you do not agree to all these Terms and Conditions, then you may not use the Service.
These Terms and Conditions govern all use of the Service including all content, services and products available at or through the servers the Service communicates with. The Company may change these Terms and Conditions from time to time. Upon any such change, the Company will update this page and thereby notify the Users that they have been changed. The amended Terms and Conditions shall automatically become effective immediately after they are updated and any use of the Service after such date shall be subject to the amended Terms and Conditions. A User's continued use of the Service after the posting of the amended Terms and Conditions on this page constitutes their acknowledgement of and agreement to these Terms and Conditions as so amended. It is your responsibility to check the website Terms and Conditions page periodically for changes.
To use the Service, individuals must create a user account by providing a real name, valid email address, and creating a password. By creating an account, users affirm that they are legally entitled to enter into this agreement and that the information provided is accurate, complete, and current.
Users are responsible for maintaining the confidentiality of their account information, including their password, and for all activities that occur under their account. Users agree to immediately notify The Company of any unauthorized use of their account or any other breach of security. The Company will not be liable for any loss or damage arising from the user's failure to comply with this section.
The Company takes reasonable steps to protect the security of user accounts but cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Users should take care when entering information and accessing their accounts only in secure environments.
The Company is committed to protecting the privacy of children. the Service is not designed for or intentionally targeted at children. We do not knowingly collect or maintain personal information beyond the name and email address required for logging in to the Service.
There may be instances where a child's information is indirectly involved, such as through the management of a pony or horse by Stables using our platform. In such cases, any information related to children is strictly limited to what is necessary for the intended use of the Service and is not utilized for any unrelated purposes. We strongly encourage parents and guardians to monitor and guide their children's online activities and interests.
If the Service is used for any purpose other than the Intended Use particularly the storage of media or records which are clearly not related to the Intended Use, the Company may at its own discretion remove any data or media relating to those Stables and if necessary deny users access to those Stables.
For the continued use of the Service we require a valid contact email address for the Administrator of each Stables, so that we can contact them if there are any usage issues or they need to request a forgotten password. There is a mechanism to Verify your email address within the User Home Screen of the App. If we do not have a valid email address for an Administrator, we retain the right to suspend Stables which that user administrates.
The Service is for assisting with the management of equestrian stables. It is an aid to stable management and record-keeping only, and is not a substitute for professional veterinary, equine, or other specialist advice. Users should always seek qualified professional guidance for decisions affecting the health, welfare, or safety of horses. The Company makes no warranty as to the accuracy of any features of service or how long data is stored in the Company's servers and shall not be liable for any special, incidental or consequential damages as a result of any inaccuracy or loss or corruption of data.
This Agreement does not transfer from the Company to you any Company or third party intellectual property. All rights in the Company's software applications, product names, company names, trademarks, trade names, service marks, logos and designs of the Company or third party products or web sites, whether or not appearing with the trademark symbol, belong exclusively to the Company or their respective owners.
In no event will the Company, or its suppliers or licensors, be liable with respect to any subject matter of these Terms of Service under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; or (ii) for interruption of use or loss or corruption of data. The Company shall not be liable for failure or delay resulting from a condition beyond the reasonable control of the Company, including but not limited to acts of God, government, terrorism, natural disaster, labour conditions and power failures.
The security of your data is extremely important to us. We take appropriate measures to ensure that your data is protected against unauthorised access, modification or deletion. We also review these measures on a regular basis to ensure they remain effective.
When you sign up to the Service, your real name and email address are used for registration. Your email address or name will not be published, supplied to third parties or used for tracking. It will only be used in connection with your use of the Service, information about features within the Service or support issues arising from the Service.
Any time you visit a page on the internet or store or retrieve data remotely via an app, you send information to a server. When the Service communicates with our servers, that information includes your IP address, device type, the date and time of your visit and the feature accessed. When you visit a page on our website, that will also include one or more cookies. This information is only ever used to improve your service, develop new functionality, to solve technical or data problems and to investigate abuse.
In the case of your IP address, these numbers could theoretically be used to identify information about you, possibly including your home ISP or the Work account where the IP address is registered. Your IP address could therefore potentially be used in conjunction with other data to identify you. That is not something we do, but we are obliged to make you aware of that risk.
The Company is committed to protecting the privacy and security of our users' data. We comply with the General Data Protection Regulation (GDPR) for users within the United Kingdom and the European Union, and we endeavor to provide a high standard of data privacy to all our users, regardless of their location.

For the avoidance of doubt this relates to data personal to you, not the application data about your stables.
We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.

We do not sell or share personal data with third parties. Data may be released to comply with our legal obligations, to enforce our Terms and Conditions, to protect the rights, property, or safety of the Company, our users, or others, or in the event of a request from law enforcement or other government agencies.

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of the United Kingdom.
The parties agree to use their best efforts to resolve any dispute arising out of or in connection with this Agreement through friendly negotiations amongst themselves. If the matter is not resolved by negotiation within a period of 30 days, then the dispute shall be submitted to the exclusive jurisdiction of the courts of England and Wales.
In the event of any legal proceedings related to this Agreement, the prevailing party shall have the right to recover from the other party its reasonable legal fees and costs.
